At the Law Offices of Geraldine Kluska, we are dedicated to providing quality and affordable legal assistance to clients who are facing the difficult decision of filing bankruptcy in Massachusetts. For more than fifteen years, we have provided advice and representation in bankruptcy cases to both consumer and small businesses. We understand how stressful it can be to be hounded by creditors and burdened with debt.

Our bankruptcy lawyers can assist you in stopping harassing creditors' calls, foreclosures, repossessions, lawsuits, utility shut-offs, tax levies and seizures, and wage garnishments. We can help you keep your home, business, automobiles, pension/retirement accounts and other assets. A bankruptcy discharge will eliminate most, if not all, of your debt and give you a fresh start, debt-free!

Don't delay any longer-if you have been unable to pay-off your credit card for a year or more, nothing is going to change, unless you win the lottery or start earning a lot more money. The longer you wait to file bankruptcy, the longer it will take to start over and rebuild your credit. It only takes a year or so to be on your way to financial freedom (you can start rebuilding your credit immediately after your case is closed with a secured credit card and can normally buy a home a year later). The whole process takes about four months if you file a chapter 7 or straight bankruptcy--the chapter most people file under. If you are a high wage earner with non-exempt assets, we can help you file under chapter 13-reorganization of your debt-and establish an affordable payment plan for you to pay back a small portion of your debt.

Small Businesses
If you are a small business owner, you may benefit from a chapter 13 if you are unincorporated or a chapter 11 if you are incorporated. Both chapters 11 and 13 allow you to stay in business and reorganize your debt by paying only a portion of it under a plan of reorganization filed and approved by the bankruptcy court. Or if you would like to close your business and liquidate your assets, if any, and discharge your remaining debt, then chapter 7 is for you.
